Thank you for visiting us, our Terms and Conditions are outlined in here and apply to all online orders, telephone orders and orders placed in-store. It is important that you read these Terms and Conditions carefully and only use our services if you agree with everything that is outlined here.
This website is for personal use and should not be used for commercial purposes. All references in these Terms and Conditions to “we”, “our”, “us” apply to Hanakago. We advise all our customers to review our Terms and Conditions regularly as some details may change over time.
Orders can be placed via our online checkout process that is integrated into the Hanakago website. During the checkout process, it is mandatory that you provide us with your personal details, recipient’s details and your payment details. Before committing to buy, you are given the opportunity to check and correct your order, as well as amend any errors in your personal/recipient details. Orders will be automatically cancelled if we are unable to obtain payment authorization for your order.
We take pride in our accuracy and aim to represent our products as realistically as possible through photography, descriptions and specifications to give our customers a clear idea of what they are purchasing. If there has been a pricing or product description error however, customers will be contacted and the order may be cancelled and refunded.
All prices displayed on the Hanakago site are in Hong Kong Dollars (HKD). The price that you are shown at the time of placing the order is the price you will pay. There is however one exception to this rule, outlined below.
We take care to display our prices correctly, but errors may still occur. If the site misrepresents the value of the goods purchased, customers will be contacted as soon as the error comes to light and given the choice of cancelling the order or paying the correct price. All cancellations in this circumstance will be fully refunded. If we cannot contact a customer in such an instance we will consider the order cancelled.
It is recommended that customers visit the site regularly as prices and offers may change.
We accept payments from all major credit cards – American Express, Mastercard, Visa, and Visa Debit. Hanakago operates in Hong Kong Dollars (HKD), consequently if you are paying with a foreign currency denominated account, you may incur extra charges through the currency conversion scheme practiced by your credit card issuer.
During the online ordering process customers are asked to provide us with their personal contact details as well as the recipient’s. In the event of a problem arising, Hanakago will contact the customer or the recipient to resolve the issue, thus it is essential that the correct information is given to avoid delays in delivery. Please ensure you have given us the correct full name, address, postcode, and contact number for yourself and the recipient.
If incorrect personal details are given, there may be a delay in delivery. We are not liable for late or non delivery, or delivery to the wrong address if the customer has provided us an incorrect address.
If we are unable to deliver directly to the recipient, we may accept a signature from a relative or co-worker as proof of delivery. We may also leave flowers in a communal area, such as in a corridor outside the recipient’s flat, if we feel it is safe to do so.
In locations where third parties are involved in receiving deliveries such as hotels, hospitals, residences with concierge desks, or offices, the signature of the person authorized to receive the order will be accepted as proof of delivery.
In the event that we are unable to meet in person with the recipient, we will leave a card with the appropriate contact numbers for rescheduling or with details of where the flowers have been left (in communal space, at the hotel desk e.t.c.).
The availability of cut flowers and plants varies over the course of the year and is subject to seasonality. We will change our products on our website accordingly.
Due to the nature of floristry, in some rare circumstances there may be supply difficulties for unforeseen reasons that are beyond our control, in such circumstances, we reserve the right to substitute an order with a product of equal or greater value and quality.
We will not be liable for any inappropriate content contained in personalized customer messages. We do however request that customers do not write messages that are threatening, obscene or offensive.
Cancellation and Returns Policy
If you wish to change your order, a notification of 3 working days is required for fresh flower bouquets / baskets; and 2 weeks notice is required for wedding or other floral decoration arrangements. Otherwise, you may be fully charged.
No cancellation will be accepted for ordering preserved flower product in any reason upon payment made.
If you are unhappy with your order because it is faulty or incorrect, you have a statutory right to cancel the contract within 2 working days of receipt and return the product(s) to us. You are entitled to a refund, exchange or credit note at our discretion as long as the product is undamaged and remains in its original packaging. In such an instance, customers that have paid by credit card will be fully refunded into their accounts within 7 working days.
There will be no refunds made to third parties, the contract is between the customer and Hanakago. Postage and packaging costs will not be reimbursed for returned items unless the order was damaged, faulty or incorrect.
We are not liable for any indirect losses accumulated through our website and services; this includes damage to hardware, loss of data, loss of profits, and any other indirect loss of whatever nature. By agreeing to these Terms and Conditions, you agree to compensate all directors and employees at Hanakago for any claims, damages, costs and expenses including legal fees, that have been incurred by a breach of these Terms and Conditions by yourself, the customer.
During the online ordering process, customers are asked to provide personal details such as name, address and credit card details. These are by no means used by Hanakago for anything other than professional reasons and are deleted from our system once the order and delivery process is complete.
At Hanakago we respect the privacy of our customers. We will not monitor or disclose any of your personal information without your acknowledgement and consent unless required to do so for legal reasons.
We will ensure compliance by our staff with the standards of security and confidentiality prescribed under the ordinance.
Hanakago is available 24 hours a day for our customers, but if for any reason the website is unavailable for a period of time, we will not be liable. Reasons for unavailability may be due to system failure, maintenance, repair, or for reasons beyond our control and we will not be responsible to customers for delays or failure to comply with our obligations in such circumstances.
Governing Law and Jurisdiction
These Terms and Conditions are to be construed in accordance with HKSAR Law.
